Terms and Conditions for Farmyard Storie´s filmshop

Farmyard Storie´s filmshop is an online service for the provision of audiovisual content to registered users. In the service you can access movies by streaming (movie rental).

Terms

The terms of this document are valid and legally binding for all users of the service. You must read and accept these terms before using the service. By using the Service, you agree to these Terms and commit to comply with them. If you do not accept or comply with the Terms at any time, you are not allowed to use the Service.

Access to and use of the service

By paying a single amount, you can gain ownership to the product.If the purchased product can not be played, please contact Farmyard Stories Ltd support at support@dSpree.no or call 22 71 03 93 (Monday-Friday 08:00-17:00). By creating a user profile at Farmyard Stories, you are also automatically added to receive Farmyard Stories´ newsletter. If you do not wish to receive this newsletter, it will be possible to remove yourself from the mailing list after the user profile has been created.

In order to register a Farmyard Stories account and use the service, you must:

a. Be 18 years old;

b. Ensure that the personal data in the registration are accurate and complete at all times;

c. Use only the service in the territory where you live. We are in no way responsible for costs, offenses or anything that may arise from use or attempted use outside of the territory. Farmyard Stories is also not responsible for costs incurred by data usage when streaming content from the service.

d. Use the service is for personal and private use only and not for commercial or public purposes;

e. Ensure that you have a suitable internet connection;

f. Verify that devices registered for use of the service are updated according to the FAQ page on the website;

g. Do not use or allow others to use the Service for illegal or inappropriate purposes;

h. Use valid payment information Equipment, systems and connections

Before making a one-time payment, you will need to make sure that you have the necessary equipment, systems, and connections to use the service. Make sure you have the latest version of browsers or apps that are linked to the service. Information can be found under FAQ on the website. [GB2] Even if you meet the system requirements, we can not guarantee that the service will always work for you. This may be due to the device's operating system or your bandwidth. You can register and use the service of up to five (5) devices. You can not delete more than three registered devices within a 24 hour period. Farmyard Stories accepts no responsibility for the devices, their performance or service compatibility.

The ability to use the service may be affected by internet failure, other networks, ISPs, electronic, data or other communication problems or failures that Farmyard Stories as no control over. You agree that we can not be held responsible for this when you register an account, log in or purchase / pay for a product in the service.

Username and password security

Your username and password are confidential and you should never share them with others. Farmyard Stories may ask you to change your password at any time, but Farmyard Stories will notify you of this in good time. You agree that this may lead to temporary interruptions in your access to the service.

If you suspect your username and/or password are being used by others, you should report this to Farmyard Stories immediately and change your password. If Farmyard Stories has reason to believe that a user account has been shared with others or otherwise misused by an unauthorized person, Farmyard Stories may immediately disable your account and cancel your access to the service, or take other precautions to prevent continued prohibited behavior.

Data retention and database

Farmyard Stories stores personal data (contact information), provided by the user via the registration page for the sole purpose of sending newsletters. Stored data is only visible to the Farmyard Stories´ staff via the dSpree database, which is secured with individual passwords for Farmyard Stories´ staff.

a) Farmyard Stories does not require or store personally sensitive information.

b) Personal data will be stored securely and not sold to third parties.

c) The user may update/modify personal data at any time. Your personal data can deleted by contacting Farmyard Stories

d) By logging in and using the Farmyard Stories´ service, the user accepts the processing of personal data at Farmyard Stories.

Farmyard Stories guarantees

Farmyard Stories guarantees that a user will be able to opt out of direct marketing when the subscription to the newsletter is terminated.

a) Farmyard Stories will not share the user's personal data with third parties.

b) Farmyard Stories will not sell the user's personal data to third parties.

c) Personal data disclosed by users will be handled in accordance with applicable rules.

Cookies

Cookies do not contain personal data and will not be sold by Farmyard Stories to third parties. Most browsers either make the user aware of the use of cookies and allow the user to refrain from using cookies. When the user rejects cookies, it may affect the user's user experience on the website.

a. Farmyard Stories uses the user's data in the following situations:

b) For data processing in the Farmyard Stories´ database

e) To track the consumption of movies on the website.

Account interruptions

The user's personal data will not be stored for more than 30 days after the user has canceled their account at Farmyard Stories. After this time the mailing list will be updated and the user will no longer receive newsletters or marketing directly from Farmyard Stories.

Force Majeure

Each party is not liable for non-compliance with its obligations arising from a "force majeure event" or event arising from the other party, third party or for external reasons such as social unrest, civil or military action, natural disasters, fire, water damage, interruption or malfunction of the communications network. However, it is understood that the parties affected by the force majeure event must do everything to limit the duration and the effects of such a force majeure event or external cause.

Minors

The service may contain material that is unsuitable for minors and which may also be offensive to some. Farmyard Stories is not responsible for use and it is the responsibility of any user to ensure that such content is not displayed or can be consumed by persons below the age limit of specific content. Farmyard Stories supplies a service and content that is produced by 3^rd parties and acts only as a sales channel for the content provided.

E-mail address

Information and messages from us are sent to the email address you provided when registering. It is important that you update your account information immediately if you change your email address. We will always use the most up-to-date email address provided to communicate with the customer

Payments and residual debts

One-time payments are paid and deducted from the specified credit, debit card or other agreed payment method provided by the user.

It is your responsibility to ensure that you can pay the purchase fee when the amount is due. In case of late payment, we may charge interest for late payment fees and charges. Any unpaid fees may be subject to debt collection in accordance with applicable law. If there are insufficient funds to cover the fees, Farmyard Stories has the right to engage debt collection agencies to collect the outstanding monies.

Prices and package changes

When you purchase a service, you will be charged the amount according to the current price displayed using the payment method you provided. Current prices are available on the website. We reserve the right to change prices with short notice if our service costs increase due to higher taxes or fees, exchange rate changes, changes in fees to third parties, decisions taken by the authorities or changes to legislation or other regulations. We do not refund any fees already paid. We do not refund fees based upon a lack of use of the service by the user.

Termination

Farmyard Stories may terminate or suspend your access to the Service at any time. If we terminate the agreement, we grant you access to the individual service(s) you have already purchased with one-time payment for the remainder of the service's term of validity.

Termination can be actioned due to:

a. Unauthorized or suspected unauthorized use of the Service

b. Violation of the Terms

c. Fees outstanding for more than 10 days after purchase. After which time Farmyard Stories has the right to immediately cancel the user's account.

Cancellation Right

Once a purchase is completed it is final. The user has no right to a refund or reimbursement.

Intellectual Property Rights

The content of the service is protected by Norwegian and international intellectual property rights, including the provisions of the Copyright Act. All copyrights and other intellectual property rights in the material or content of the Service belong to or are licensed by Fantasi-Fabrikken AS/Farmyard Stiroes Ltd. Farmyard Stories gives you a non-exclusive, non-transferable and unlimited license to use such personal and private use rights (not for commercial purposes), provided you do not:

a. Copy, publish, reproduce, upload, broadcast, distribute, transfer or otherwise make available to the public the content of the service or allow others to do so;

b. Download, distribute or share content from the Service, use the content of a device that is not registered by you or display the content publicly

c. Circumvent, remove, reconstruct, decompile, disassemble, modify or otherwise falsify the security or encryption or other technology or software that is part of the service.

You do not receive any ownership or any rights to the Service beyond the above-mentioned license.

Violation of these provisions and breach of intellectual property rights shall always be considered as a material breach of these Terms and Conditions and will give Farmyard Stories the right to terminate the service immediately and / or render the Service unavailable to you or otherwise prevented illegal conduct.

Security

Do not attempt to bypass our security systems or otherwise try to test the security of the service.

You may not use the Service in a manner that may damage, disable, overload, prevent or infringe other users' use of the Service. This includes sending or transferring material containing computer viruses or other data codes, files or programs designed to damage, interfere, destroy or limit the functionality of software, hardware or equipment directly or indirectly connected to the service.

You may not attempt to gain unauthorized access to systems, networks, content or information that constitute the site, service or systems on which the service is based. Do not attempt to obtain any material or information that is not intended to be made available or available on the service.

Violation of these provisions shall be considered as material breach of these Terms and Conditions, giving Farmyard Stories the right to terminate the Service for you immediately and / or render the Service unavailable to you or otherwise prevent illegal conduct.

Our responsibility

The service is offered "as is" and "as available" and we provide no warranties or promises of the accuracy or completeness of any content, information, services or other material offered on or through the service. Farmyard Stories provides no express or implied warranties of functionality, accessibility, quality, usability or security of service.

Neither Farmyard Stories nor our affiliates, directors, directors, employees, licensors or third parties may under any circumstances be held liable for direct or indirect damages or consequential damages that may arise due to use or inability to use the Service or third party services available from website or service.

Allowance

You agree to keep Farmyard Stories´ subsidiaries and affiliates, as well as all our board members, officers, agents, contractors, partners and employees innocent from and against all losses, debts, claims and expenses, including attorney fees which may occur as a result of or in connection with breach of these terms or violations of laws, regulations or third party rights.

Privacy Policy

We process information about you in accordance with our Privacy Policy (GDPR). By using the website or service, you agree to this processing.

Social Media

The service may allow you to make your profile publicly available, to share links with other users of the service, or to integrate the use of the service with the functionality offered by third party social networking services such as Facebook and Twitter ("Social Media"). If you choose to use this option, for example, by linking your profile to a Facebook account, it may be possible for the public or for other users to view your Farmyard Stories profile. We are not responsible for the content when it is shared on social media, and you should review the relevant terms of use on the respective social media websites.

If you use social media connected with the service, you agree that you will not use it in any way that we consider unacceptable.

Current law

Norwegian law governs these terms. For any lack of friendly agreement, any claims, terms or violations are governed by the Norwegian courts.[KS1]
